UAE tax residency

UAE tax-residency criteria are set at federal level and apply across all seven emirates. Where you live or work within the UAE does not change the criteria — although your emirate is relevant to licensing, tenancy records and the documents you will hold as evidence.

UAE tax residency

A plain-language guide to what tax residency means in the UAE, which criteria are usually tested, and how treaty residency differs from domestic residency.

What tax residency means

Tax residency describes the country that treats you, or your company, as belonging to its tax system. It is determined by the rules of each jurisdiction — not by nationality, and not by where a bank account or a company registration happens to sit. Being tax resident in the UAE does not automatically end tax residency somewhere else, and losing residency elsewhere does not automatically create it in the UAE.

UAE individual residency criteria

The UAE tests individual tax residency mainly through physical presence and, for a defined group of people, a shorter presence period combined with a relevant UAE connection such as a permanent place of residence, UAE employment or UAE business activity. This checker tests the criteria in the current rule set and tells you which of them your answers appear to satisfy.

Day-count considerations

Day counting is factual and needs evidence. Keep passport stamps, entry and exit records or an official travel report for the relevant period. Where you are close to a threshold, the treatment of partial days and the exact period being measured matter, and both should be verified rather than assumed.

Permanent place of residence

A permanent place of residence generally means a home that is continuously available to you — owned, rented long-term, provided by an employer, or a family home. Availability matters more than ownership. Having a home available in more than one country does not decide the question by itself; it usually means the wider facts need to be looked at.

Personal and financial interests

Where your home, family, employment, business, investments and financial affairs are centred is relevant context. No single one of those connections determines tax residency, but taken together they help explain which country a person's life is genuinely centred in — which is exactly what a tax authority or a treaty tie-breaker examines.

UAE corporate tax residency

For companies, UAE Corporate Tax residence typically turns on whether the entity is incorporated or established in the UAE, and — for foreign entities — whether it is effectively managed and controlled in the UAE. Management and control is a question of where decisions are actually taken and evidenced, not where the constitutional documents say they should be. A UAE trade licence alone is not evidence of tax residence for every purpose.

Tax Residency Certificates

A Tax Residency Certificate is official evidence issued through the applicable FTA process, usually to support a treaty claim or a request from a foreign authority or institution. It is issued for a defined period and purpose and requires supporting documentation. This checker does not issue, replace or predict a certificate.

DTAA considerations

Where two countries both treat you as resident, the applicable double-taxation agreement may contain tie-breaker rules, and treaty benefits usually depend on satisfying the treaty's own conditions. You can compare UAE tax treaty positions as a starting point, but a treaty conclusion needs the specific facts analysed.
